我国进口转基因农产品法律规制研究——基于《SPS协议》的利用研究

在转基因农产品大量涌入我国的背景下,分析找出我国对于进口转基因农产品规制存在的三个问题：关税结构不合理,规制转基因产品的措施未能及时有效地实施,未将《SPS协议》中的风险评估体系纳入进口规制。指出,我国进口转基因农产品法律规制应适当利用相关国际协议,加强对《SPS协议目标、原则及临时措施的利用,建立我国自己的进口检疫标准对进口转基因农产品进行适当规制,以更好地维护我国的经济和贸易利益。

On Legal Regulation of Imports of Transgenic Agricultural Products based on SPS Agreements

In the context of the influx of transgenic agricultural products to China, the three problems are analyzed, including that the tariff structure is irrational, the implementation of measures on regulation of genetically modified products is not timely and effective, and the risk assessment system in SPS agreement is not in the imports regulation. It is pointed out that the legal regulation of transgenic agricultural product imports in China should use the relevant international agreements such as the objectives, principles and interim measures of SPS agreement appropriately, and the import quarantine standards should be built to regulate the import transgenic agricultural products and preserve our economic and trade interests.
