保护少数民族文化权利立法状况考察

文化权利是公民基本权利,保护少数民族文化权利是全面实现人权价值的必然要求。随着城市化进程的不断加快,对保护少数民族文化权利的法律体系提出了新的更高要求。文章从国家立法、国家部门立法和地方立法方面,分析了我国多层面、全方位构建和完善少数民族文化权利保护体系,提出保护少数民族文化权利立法体系的完善是一个动态的过程,应当随着社会的发展和时代的进步不断更新理念、拓展内容、强化措施。

Study on the Protection of the Cultural Rights of Minority Nations through Legislation

Cultural rights are fundamental rights of citizens, and the protection of the rights of minority nations isthe requirement of overall realization of human rights values. With the acceleration of urbanization, the legal sys-tem needs to be updated to protect well the cultural rights of minority nations. Thus, In China, the legislative pro-tection system of the cultural rights of minority nations is being improved at the level of national legislation, na-tional section authorities and local legislation.
