| 摘 要： | 分析道路交通事故机动车损害赔偿责任主体认定的弊端，根据危险责任和报偿责任理论，提出将对机动车运行有支配力及从中获得利益的人作为损害赔偿责任主体的认定标准，并在此基础上对机动车一方损害赔偿责任的具体主体予以简要评析。

| Abstract: | This essay analyses the disability to define the subjects of the damage compensation responsibility for road traffic accidents.According to the theory of danger responsibility and the compensation responsibility,it is necessary to take the person controlling and profiting from the motor vehicles' running as the subjects of the damage compensation responsibility.On this basis,the author briefly analyses the concrete subjects. |
