| 摘 要： | 明末清初思想家批判君主专权危害,形成了他们的民权思想;明末清初思想家批判君主专制政体的思想,演变为近代思想家对民主政体思想的接受;明末清初思想家的民权思想演变为近代思想家的权利思想和民主思想。可见,中国法律近代化必然是不能和传统法律文化相分离的。

| Abstract: | The advance thinkers in the late Ming and early Qing Dynasty had fonned their thoughts of democratic rights through criticizing the autocratic monarchy . Their law thoughts of criticizing the autocratic monarchy had developed democratic government In Chinese modern times; Their law thoughts of democratic rights also had developed thoughts of rights and democracy in Chinese modern times. In conclusion, the moderation of Chinese law has indivisible relation with traditional law culture. |
