| 摘 要： | 文章认为法定物权贬降说是说明自然物权本质的适宜理论,并认为自然物权中亦蕴含道德义务.自然物权的受领和保有权能,是自然物权产生民法效果的基础,民法需对自愿给付后的效果加以保护,自然物权依此得恢复为法定物权.此外,自然物权可以获得实证法上的支持,民法规定自然物权具有极大的意义.

| Abstract: | This paper adopts the demotion of legal right of real claim as the theory to explain the essence of Natural Real Right,and agrees therein there is moral obligation.The power and function of accepting and retaining are bases for effect of Natural Real Right in civil law,and civil law shall protect the effect brought by voluntary giving,upon this Natural Real Right gets changed back to legal Real Right.Natural Real Right has support from positive law and there is great significance for civil law to stipulate such right. |
