人民监督员制度司法实践初探

人民监督员制度是最高人民检察院为确保其职务犯罪侦查权和起诉权的正确行使,2003年秋季引入了民主监督制度,不仅体现了人民群众的基本要求,也加强全国人民代表大会的刚性监督力度。学理上宜探讨人民监督员制度化的必要性和价值目标,在检察权制衡下实现监督权同检察权的良性互动,同时国家应立足于中国司法制度实践,对人民监督员制度化路径展开研究,分析制度缺陷,从实践和理论上对制度予以完善。

The Exploration of Judicial Practice of the People＇s Supervisor System

In order to ensure the correct use of job - related crime investigation right and right of action, in the fall of 2003, the Supreme People＇ s Procuratorate introduced the people＇ s supervisor system, which not only re- flects the basic demand of the people, but also strengthens the NPC＇ s rigid supervision. Academically we should explore the necessity and value target of the system and realize positive interaction of supervision power and procura- torial power under the check and balance of procuratorial power. Meanwhile, the state should on the basis of Chi- na＇ s judicial practice make a study of institutionalized paths of the system, analyze the defects in the system, tries to perfect the system theoretically and practically.
