| 摘 要： | 我国关于刑事附带民事诉讼的赔偿范围,从刑法、刑事诉讼法的相关规定来看,均限定为物质方面的损失.刑事被害人精神损害制度的确立,是十分必要的.最高人民法院《关于审理人身损害赔偿案件适用法律若干问题的解释》并未从法律层面上对之加以解决,只有从修改现行立法入手,才能从根本上解决这一问题.

| Abstract: | Seen from the concerned rules of the criminal law or the code of criminal procedure in China,the compensation range is defined to the material.It is necessary to found the spiritual damage system for criminal victims.This problem has been legally solved by Supreme People's Court Interpretation on the Matters of Law Application Trial of Personal Injure Compensation Cases and it can be properly dealt with only when the current law is amended. |
